1. Acceptance of Terms

By accessing or using TourBot, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

You must be at least 13 years old to use TourBot. By using the App, you represent and warrant that you meet this age requirement.

2. Account Registration

To use certain features of TourBot, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

You may not transfer your account to another person or use another person's account without permission.

3. License and Restrictions

License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the App
• Copy, reproduce, or distribute any part of the App without permission
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any part of the App
• Use automated systems (bots, scrapers) to access the App
• Impersonate any person or entity

4. User-Generated Content

Your Content

You may create, upload, and share content through TourBot, including custom tours, ratings, and reviews ("User Content"). You retain ownership of your User Content.

License to Us

By submitting User Content, you grant TourBot a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and improving the App.

Content Standards

You agree that your User Content will NOT:

• Violate any law or regulation
• Infringe on intellectual property or privacy rights
• Contain hate speech, harassment, or threats
• Include spam, malware, or viruses
• Be false, misleading, or deceptive
• Contain sexually explicit or violent content
• Promote illegal activities or substances

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without notice.

5. AI-Generated Content and Disclaimer

TourBot uses artificial intelligence (Anthropic's Claude) to provide tour guidance and information.

Important Disclaimers:

• AI-generated content is for informational and entertainment purposes only
• We do not guarantee the accuracy, completeness, or reliability of AI-generated information
• AI responses may contain errors, outdated information, or inaccuracies
• Do not rely solely on AI-generated content for critical decisions
• Always verify important information from official sources
• We are not responsible for any consequences resulting from reliance on AI content

6. Location Services

TourBot provides location-based features including GPS navigation and mapping.

Location Services Disclaimer:

• Location data and navigation are provided "as is" without warranties
• GPS accuracy may vary based on device, signal, and environmental conditions
• Always use common sense and observe your surroundings while touring
• Do not trespass on private property or enter dangerous areas
• We are not responsible for navigation errors or location inaccuracies
• You are solely responsible for your safety while using the App

7. Subscriptions and Payments

Subscription Plans

TourBot offers premium features through subscription plans. By subscribing, you agree to pay the applicable fees.

Billing

• Subscriptions automatically renew unless cancelled before the renewal date
• Payment is processed through Apple App Store or Google Play Store
• Prices are subject to change with notice
• You are responsible for all charges incurred under your account

Cancellation and Refunds

• You may cancel your subscription at any time through your device settings
• Cancellation takes effect at the end of the current billing period
• Refunds are handled according to Apple App Store or Google Play Store policies
• We do not provide refunds for partial subscription periods

Free Trials

Free trials (if offered) automatically convert to paid subscriptions unless cancelled before the trial ends. You will be charged when the trial period expires.

8. Intellectual Property

The App and its original content, features, and functionality are owned by TourBot and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

TourBot trademarks, logos, and service marks displayed in the App are our property. You may not use these without our prior written consent.

9. Third-Party Services

TourBot integrates with third-party services including:

• Apple Maps and Google Places API for mapping and location data
• Anthropic API for AI-powered features
• RevenueCat for subscription management
• Better Auth for authentication services

These third-party services have their own terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

10. Disclaimers and Limitation of Liability

No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOURBOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP.

We are not responsible for:

• Personal injury, property damage, or accidents occurring during tours
• Loss or theft of personal belongings
• Inaccurate location data or navigation errors
• Errors in AI-generated content or tour information
• Service interruptions or technical issues
• Actions or content of other users

11. Indemnification

You agree to indemnify, defend, and hold harmless TourBot and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content

12. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At our sole discretion for any reason

Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App settings.

13. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which TourBot operates, without regard to conflict of law principles.

Arbitration

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and TourBot individually. You waive your right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Effective Date" at the top of this page
• Notify you through the App or via email for material changes
• Post the updated Terms on our website

Your continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TourBot regarding the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
